Achay Application

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Application. By using the Application, you represent and warrant that:

• You meet the eligibility requirement and have the legal capacity to enter into these Terms.
• All information you provide during registration is accurate and truthful.
• You will comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.

2. User Registration and Accounts

• Registration Process: To use the Application, you must create an account by providing your phone number. During registration and each login, you will receive an OTP via SMS for verification. You are responsible for maintaining the confidentiality of your account credentials and OTPs.
• Account Security: You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.
• Accurate Information: You must provide true, accurate, current, and complete information during registration and keep it updated. We reserve the right to suspend or terminate your account if any information is found to be inaccurate or incomplete.
• One Account Per User: Each user is permitted to maintain only one account. Creating multiple accounts may result in suspension or termination of all associated accounts.
• SMS Communications: By providing your phone number, you consent to receive SMS messages for OTPs and service-related notifications. Standard messaging rates from your carrier may apply.

3. Notifications

• Push Notifications: The Application may send push notifications to your device regarding your reservations and important service updates. You can manage notification preferences through your device settings or within the Application.
• Types of Notifications: You may receive:
  • Reservation confirmations and updates
  • Reminders for upcoming reservations
  • Payment confirmations and receipts
  • Service announcements and maintenance notices
• Essential Notifications: Security-related notifications (such as OTP codes) and payment confirmations cannot be disabled while using the Application.

4. Table Reservations

• Booking Process: The Application allows you to select available dates, times, and branches for table reservations at Achay locations. Reservations are subject to availability and confirmation.
• Confirmation: A reservation is confirmed only after successful payment processing. You will receive a confirmation notification via the Application and/or SMS.
• Reservation Details: Please ensure all reservation details (date, time, number of guests, branch) are correct before completing your booking. You are responsible for arriving at the correct branch at the reserved time.

5. Cancellation Policy

• Cancellation by User: You may cancel your reservation through the branch, provided that the booking is rescheduled to another time, subject to availability. Refunds are not available.
• Branch Transfers: You may transfer your reservation from one branch to another by contacting our support team through the Application, subject to availability at the desired branch.
• Cancellation by Achay: We reserve the right to cancel reservations due to unforeseen circumstances (such as branch closure, maintenance, or force majeure events). In such cases, you will receive a full refund and be notified as soon as possible.

6. No-Show Policy

• Definition: A "no-show" occurs when you fail to arrive at the branch within 15 minutes of your reserved time without prior cancellation.
• Consequences: Repeated no-shows may result in restrictions on your account, including temporary or permanent suspension of booking privileges.
• Notification: If you cannot attend your reservation, please cancel it through the Application as early as possible to allow other customers to book.

7. Payments

• Payment Gateway: All payments are processed through secure third-party payment gateways integrated within the Application. By making a payment, you agree to the terms of the payment gateway provider.
• Fees and Charges: You are responsible for all fees associated with your reservation, including any applicable taxes or service charges displayed at checkout. Prices are displayed in Saudi Riyal (SAR) and are subject to change without prior notice.
• Payment Authorization: You authorize us and the payment gateway to charge your selected payment method for the reservation amount. You represent that you are authorized to use the payment method provided.
• Payment Security: We do not store your complete credit or debit card information. All payment data is handled securely by our payment gateway providers in compliance with industry standards.
• Failed Payments: If a payment fails, your reservation will not be confirmed. You may retry the payment or use a different payment method.

8. User Conduct and Prohibitions

You agree not to:

• Use the Application for any unlawful purpose or in violation of any local, national, or international law.
• Attempt to interfere with the Application's functionality, including hacking, transmitting viruses, or overloading the system.
• Misuse OTPs, create multiple accounts, or impersonate others.
• Make reservations you do not intend to honor.
• Share your account credentials with others.
• Use automated tools, bots, or scripts to access the Application or make reservations.
• Attempt to circumvent any security features of the Application.

We reserve the right to investigate and take appropriate action, including account suspension or termination, for any violations.

9. Intellectual Property

The Application, including its design, features, logos, graphics, and content, is owned by Achay or its licensors and protected by intellectual property laws of the Kingdom of Saudi Arabia and international treaties. You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Application.

10. Privacy

Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Application, you consent to our data practices as described in the Privacy Policy. Please review the Privacy Policy carefully before using the Application.

11. Third-Party Services

The Application integrates with third-party services, including SMS providers and payment gateways. We are not responsible for the availability, accuracy, or security of these third-party services. Your interactions with third parties are governed by their respective terms and policies.

12. Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:

• The Application will be error-free, secure, or uninterrupted.
• Any defects will be corrected.
• The Application will meet your specific requirements.

13. Limitation of Liability

To the fullest extent permitted by the laws of the Kingdom of Saudi Arabia, Achay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or your use of the Application shall not exceed the amount you paid for the specific reservation in question.

14. Indemnification

You agree to indemnify, defend, and hold harmless Achay, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Application.
• Your violation of these Terms.
• Your violation of any rights of third parties.
• Any content you submit or transmit through the Application.

15. Termination

• Termination by Achay: We may terminate or suspend your access to the Application at any time, with or without cause or notice, for any reason, including breach of these Terms.
• Termination by User: You may stop using the Application at any time and request account deletion by contacting us.
• Effect of Termination: Upon termination, your right to use the Application ceases immediately. Any pending reservations may be cancelled, and refunds will be processed according to our cancellation policy.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or relating to these Terms or your use of the Application shall be resolved through the competent courts in the Kingdom of Saudi Arabia. Before initiating legal proceedings, we encourage you to contact us to attempt to resolve any disputes amicably.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the Application or push notifications. The "Last Updated" date at the top indicates when these Terms were last revised. Your continued use of the Application after changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Application.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Achay regarding your use of the Application and supersede any prior agreements or understandings.
